01. Acceptance of Terms
By accessing or using the TalkChat platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms constitute a legally binding agreement between you ("User") and TalkChat regarding your use of the website and services.
02. Nature of Service & AI Disclaimer
TalkChat provides access to advanced Artificial Intelligence models for conversational purposes.
- Not a Person: You acknowledge that you are interacting with machine learning algorithms, not human beings.
- No Professional Advice: The AI is not a licensed professional (medical, legal, financial). Any advice given is simulated and should not be relied upon for real-world decisions.
- Hallucinations: AI models may generate incorrect, coherent-sounding but factually false information ("Hallucinations"). We do not guarantee the accuracy of generated content.
03. User Conduct & Restrictions
You agree NOT to use the Service to:
- Generate illegal content, including child sexual abuse material (CSAM), non-consensual sexual content, or content promoting violence/terrorism.
- Attempt to reverse engineer, decompile, or extract the model weights or underlying code.
- Use "Jailbreak" prompts designed to bypass safety filters or generate prohibited content.
- Harass, bully, or incite hatred against individuals or groups.
ZERO TOLERANCE POLICY: TalkChat uses automated detection systems. Any generation of illegal content (CSAM, Terrorism) will result in: 1) Immediate ban. 2) Preservation of data. 3) Report to competent authorities (Pharos/Interpol).
04. Intellectual Property Rights
Platform Content: TalkChat retains all rights, title, and interest in and to the Platform (code, design, branding).
User Generations: Subject to compliance with these Terms, you own the rights to the text content you generate using the Service. You grant TalkChat a non-exclusive, worldwide license to process this content solely for the purpose of providing the Service. We do NOT use your private chats to train our public base models without explicit consent.
05. Virtual Currency ("TalkCoins")
- No Real World Value: TalkCoins are a virtual license to access features. They have no monetary value and cannot be exchanged for cash.
- Waiver of Right of Withdrawal: By clicking "Buy" and receiving TalkCoins immediately, you expressly request immediate performance of the service and acknowledge that you lose your right of withdrawal (Consumer Code Art. L221-28).
- Expiration: We reserve the right to expire unused TalkCoins if an account remains inactive for over 12 months.
06. Limitation of Liability
DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALKCHAT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.
IN NO EVENT SHALL TALKCHAT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
07. Age Restrictions
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use TalkChat. By using the Service, you warrant that you maintain the legal capacity to enter into this agreement. Any account found to be used by a minor will be terminated immediately. We reserve the right to request ID verification in case of doubt.
08. Governing Law
These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. The French courts shall have exclusive jurisdiction to settle any dispute related to these Terms.
